ROMANIA: Farmec wins a 15 million euros lawsuit with ANAF | Progresiv
Cluj Court of Appeal has ruled in favor of Farmec company against the National Agency for Fiscal Administration regarding the decision on imposing a penalty of nearly 18 million euros. The Decision with number 46 was delivered on February 18th 2016. The amount would have accounted, according to documents issued by the tax authorities within ANAF, excise duties, interest and penalties for late payment of the denatured alcohol used, between 1 January 2007-31 December 2011 for the manufacture of three products: Airwick aerosols, Nufar and Triumf.
“The decision of Cluj Court of Appeal states that Farmec has always complied with tax obligations and commitments to its partners and is on schedule with the payment of all taxes and contributions owed to the state. Let us hope that such unfortunate incidents, these completely erroneous interpretations of the legislation in force, coming even from the tax authorities, which should have the best knowledge of tax law in Romania, will not be repeated. We are one of few companies with 100% Romanian shareholders, we participate annually at the state budget, local budgets and social security budgets by an amount of 36 million lei, the equivalent of 8.2 million euros annually, and we are glad that we will still be able to support the national economy and that we guarantee the jobs of the hundreds of employees of Farmec due to the decition of Cluj Court of Appeal” said Mircea Turdean, General Director of Farmec, in a press release.
