The fine for traders of consumer products, fuel, phone and Internet services, financial or tourist services and agri-food products, is 4% of the turnover. In some cases, they may even be forced to suspend their activity for six months if they practice "double standard" in Romania.

The project proposes the following measures: the marketing of products and services for consumers counterfeit subject to the double standard is punished with a fine of maximum 4% of the turnover; in case of repeated deviation, the operating authorization of the trader can be suspended for a period of 6 months; the products referred to in paragraph (l) shall be confiscated and withdrawn from sale.

Also, "the double standard of quality of products or services for consumers means the production and marketing of a product / service as being identical to the same product sold in other member states, provided that, in fact, the product has significantly an unjustified different composition or characteristics”, according to the project.

The inspectors of the National Authority for Consumer Protection and, as the case may be, those of the National Authority for Veterinary and Food Safety will check the situation. The National Authority for Consumer Protection will collect evidence for the purpose of carrying out laboratory tests for products that may be of double standard, as well as the project, which does not give other details and does not specify how a double standard service will be identified.

The European Commission published on June 24 the results of a pan-European food testing campaign, which shows that some products are sold under the same or similar brands, but with different composition.

The study, which evaluated 1,380 samples from 128 different food products from 19 Member States (excluding Romania), shows that 9% of the products presented as being the same across the EU actually had a different composition: the front of the packaging was identical, but the composition of the products was different. Another 22% of the products were presented in a similar way, but they had a different composition.

However, in one of two cases the composition corresponded to the way the products were presented: 23% of the products had the front of the packaging and the same composition, and 27% of the products indicated, by the different aspect of the front of the packaging, that in different countries of the European Union their composition was different.
